OBTAINING A RESIDENCE PERMIT ON THE BASIS OF BUSINESS ACTIVITY (JDG/SP. Z O. O.)?

A residence permit for the purpose of conducting business activity may be obtained by a foreigner whose purpose of stay is to conduct business activity in the territory of Poland, on the basis of the provisions in force in this regard.
This permit is also issued to foreigners whose purpose of stay in Poland is to perform functions in the management board of a limited liability company.

  • Persons who perform functions in the management board, but do not hold shares in the company, must apply for a temporary residence permit in order to perform work.
  • The residence permit is issued for the period necessary to achieve the purpose of the foreigner's stay in Poland for a period of 3 months to 3 years, with the possibility of applying for another permit.
  • A residence permit for a foreigner performing work, performing functions in the management board of a limited liability company, also gives him the right to perform work in this capacity. The residence permit issued in connection with granting a temporary residence permit to a foreigner contains the annotation «Access to the labor market». When applying for another job (even in the same company), you must obtain a work permit.

Who can receive the «Residence Card» on the basis of business activity:

  • People who set up a company in Poland and are the founders;
  • Persons who have opened an individual entrepreneurship in Poland.

Basic requirements:

  • Submission of an application for a temporary residence permit in person, no later than on the last day of your legal stay in the territory of the Republic of Poland;
  • A residence permit can only be obtained in person;
  • Submit your fingerprints for a residence permit;
  • Documents in Polish should be submitted in originals or photocopies together with the originals for inspection;
  • Documents drawn up in a foreign language must be translated into Polish by a Polish sworn translator.
