Who can register an individual entrepreneurship and what are the deadlines?

Foreigners have grounds to register JDG («Individual entrepreneurship»), but with limitations.

List of people who can register JDG in Poland:

1. Polish citizens.

2. EU citizens as well as citizens of the European Economic Area may run a business on the same rights as Polish citizens.

3. US and Swiss citizens.

4. Citizens of Ukraine legally residing on the territory of Poland.

5. Citizens of countries outside the European Union, in cases where the legal grounds for their stay in Poland allow it, i.e. citizens who have:

  • Permanent residence permit («Permanent residence»);
  • A valid card of the Pole;
  • Valid Poland Business Harbor visa;
  • Long-term resident's EU residence permit;
  • Temporary residence permit granted for the purpose of undertaking higher education, research or development work, family reunion;
  • Refugee status;
  • Extra protection;
  • Temporary protection;
  • Permission for tolerated stay;
  • Temporary residence permit based on marriage with a Polish citizen residing on its territory;
  • Temporary residence permit for the purpose of conducting business activity, issued in connection with continuing business activity on the basis of an entry in CEIDG;
  • Long-term resident's EU residence permit issued by another EU Member State, if the foreigner proves that his stay in Poland is justified;
  • Family members of an EU citizen on the basis of a residence card («residence card») with the annotation «Family member of an EU citizen, art. 10 and Art. 20 of Directive 2004/38/EC»;
  • Foreigners residing legally on the territory of Poland who have submitted an application for a temporary or permanent residence permit or on the basis of a stamp in the travel document confirming the submission of an application for a long-term resident's EU residence permit, if immediately before submitting such an application the foreigner was entitled to conduct business activity on the basis of a temporary residence permit on the basis of staying with a family member holding a long-term resident's EU residence permit.

Deadlines for registration of JDG in Poland:

1. Submission of an application for registration:

The entry in the CEIDG register about your JDG (if the application for registration is correct and does not require correction) will appear no later than on the next working day after submitting the application for registration of a JDG with your data.

2. Obtaining a NIP number and a REGON number:

After the entry in the CEIDG register, you will be assigned a NIP number (tax number) and a REGON number (statistical account number) within 7 working days.

Ready! From now on, your «Individual entrepreneurship» will be considered as fully registered.
